At the law term of the Supreme Court, last week, the case of Fitz H. Lane vs. Eli F. Stacy, adm'r of E. H. Stacy, was argued and decided. It appeared that said Lane and E. H. Stacy were joint sureties on a note for the accommodation of Ignatius Winter, who had given to said Stacy security in a mortgage of certain personal property. The note was finally paid by said Lane, who claimed the benefit of the security given to Stacy, but his administrator refused and cancelled the mortgage. This was a bill in equity to compel said administrator to give up said security to Lane, and the court entered a decree in conformity to the prayer of the petitioner and for costs. Smith, Phillips.
